Terms of Service

These Terms of Service ("Terms") cover your use of cottamsskishops.com (the "Site") and the reservation requests, messages, and applications you send through it. The Site is operated by Tank, Inc. d/b/a Cottam's Ski Shops, a New Mexico S corporation ("Cottam's," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

1. What the Site is for

The Site shares information about our ski and snowboard rental shops in Taos Ski Valley and Angel Fire, New Mexico, and lets you reserve rental gear, contact us, join our mailing list, and apply for jobs. We do not sell anything or take payment on the Site.

You must be at least 18 years old to submit a reservation, contact form, or mailing list signup. Parents or legal guardians reserve on behalf of minors.

2. Online reservations

• No deposit, pay at pickup. Reserving online is free. We don't collect payment or card details on the Site. You pay in the shop at pickup.
• A reservation is a request to hold gear. We use the details you give us to size and stage gear before you arrive. We confirm by email, and we'll reach out if we can't fill your request as submitted. Specific models may be swapped for comparable gear of the same package.
• Accurate renter details. Height, weight, age, shoe size, and ability level are used to choose equipment and set ski bindings. You're responsible for giving accurate information for every renter in your party and for having their permission (or being their parent or guardian) to share it. Equipment is checked again at the counter.
• Rates. Rates on the Site are the same as in the shop. They can change and may contain errors; the rate in effect at pickup, plus any applicable taxes, is what you pay.
• The rental agreement governs the rental. At pickup, each renter (or a parent or guardian for a minor) signs our equipment rental agreement. If that agreement conflicts with these Terms, the rental agreement controls for the rental itself.

Pickup, return, and cancellation

• Pickup. Pick up after 3 PM the day before your rental starts — no extra charge.
• Return. Return by 10 AM the day after your rental ends, to the shop you rented from.
• Cancellation. No deposit to reserve online. Cancel with 48 hours' notice before pickup — call or text either shop.

To change or cancel, call or text the shop you're picking up from: Taos Ski Valley at (575) 741-2040 or Angel Fire at (575) 216-8148. You can also reply to your confirmation email.

3. Communications

When you send us a reservation, message, or application, you agree that we may contact you by email, phone, or text message about that request. We only send marketing email if you join our mailing list, and you can opt out at any time.

If we text you about a reservation (for example, a pickup reminder), message frequency depends on your booking, and message and data rates may apply. Reply STOP to opt out or HELP for help. Text messaging is not required to reserve. See our Privacy Policy for how we handle mobile numbers.

4. Using the Site

You agree not to:

• Submit false, fraudulent, or someone else's information without permission
• Make reservations you don't intend to keep, or resell reservations
• Send spam, malware, or automated requests, or try to get around our spam protection
• Interfere with the Site, our systems, or other people's use of them
• Use the Site for anything unlawful

We may decline or cancel any reservation or request, or limit access to the Site, if we believe these Terms have been violated.

5. Our content

The Cottam's Ski Shops name, logo, photos, text, and design on the Site are owned by or licensed to us and are protected by law. You may view and share pages for personal, non-commercial use. Please don't copy, modify, or reuse them for any other purpose without our written permission.

The Site links to other websites, such as Google Maps and partner lodging. We don't control those sites and aren't responsible for their content or practices.

6. Information on the Site

We work to keep hours, season dates, rates, and equipment details current. Season dates are projected and depend on weather and snow, and hours may change, especially around holidays. Call or text a shop if you need to confirm something before your trip.

7. Skiing and snowboarding risks

Skiing and snowboarding carry inherent risks of injury and death. New Mexico's Ski Safety Act (NMSA 1978, Sections 24-15-1 through 24-15-14) places certain duties and responsibilities on skiers. Nothing on the Site is a substitute for lessons, your own judgment, or the rules of the ski area you visit.

8. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Site will be uninterrupted, error-free, or free of harmful components. Warranties for rental equipment, if any, are set out in the rental agreement you sign at pickup.

9. Limitation of liability

To the fullest extent allowed by law, Cottam's and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or trip costs, arising from your use of the Site or any reservation request made through it. Because reserving online is free, our total liability for any claim arising from the Site is limited to one hundred U.S. dollars ($100).

Nothing in these Terms limits liability that cannot be limited under New Mexico law, and this section does not apply to the equipment rental itself, which is governed by the rental agreement.

10. Indemnity

You agree to defend and hold harmless Cottam's and its owners, employees, and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, information you submit that is false or that you weren't authorized to share, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state courts located in Taos County, New Mexico, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed. Changes apply from that date forward and do not affect reservations already confirmed.

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it.
